1. Overview

This Data Fair Use Policy (“Policy”) describes how Club Mobile LLC DBA Win Mobile (“Win Mobile,” “WINMO,” “we,” “us,” or “our”) manages data usage on our wireless service plans, including the conditions under which data speeds may be reduced after you reach a defined usage threshold.

By subscribing to a WINMO wireless plan, you agree to the terms of this Policy, which forms part of your overall Service Agreement with us. Please read this Policy carefully so you understand how your data service works and what to expect throughout your monthly billing cycle.

2. What Is a Fair Use Policy?

A Fair Use Policy is designed to ensure that all customers enjoy a reliable and consistent network experience. While our plans include generous or unlimited data allowances, the total capacity of any wireless network is finite. High volumes of data consumption by individual users can degrade the experience for others on the same network.

This Policy establishes reasonable usage thresholds and describes how we manage network resources fairly across our entire customer base, in accordance with Federal Communications Commission (“FCC”) Open Internet rules and applicable U.S. telecommunications law.

3. Data Thresholds and Throttling

3.1 High-Speed Data Allowance

Each WINMO data plan includes a defined high-speed data allowance (the “Threshold”) per billing cycle. Your specific Threshold is stated in your plan details at the time of purchase and in your online account dashboard.

Unlimited Plan customers: while your plan includes unlimited data, high-speed data is subject to the Threshold noted above, after which speeds may be reduced as described in Section 3.2. Additional high-speed data may be purchased — see Section 5 for details.

3.2 Speed Reduction After Threshold (Throttling)

Once you reach your plan’s high-speed data Threshold during a billing cycle, your data connection speeds will be reduced for the remainder of that billing cycle. This is commonly referred to as “throttling” or “deprioritization at threshold.”

Throttled speeds are typically sufficient for:

  • Standard-definition (SD) video streaming
  • Web browsing and email
  • Social media use
  • Music and podcast streaming
  • Messaging applications

Throttled speeds may not reliably support:

  • High-definition (HD) or 4K video streaming
  • Large file downloads or uploads
  • High-resolution video conferencing
  • Cloud backups of large data sets
  • Online gaming requiring low latency

3.3 Network Management and Deprioritization

In addition to threshold-based throttling, Win Mobile practices network management techniques to maintain service quality for all customers. During periods of network congestion, customers who have used a significant amount of data in the current billing cycle may experience temporary speed reductions compared to other customers — even before reaching their Threshold.

This temporary deprioritization is applied only during active periods of network congestion and in a non-discriminatory manner consistent with FCC Open Internet rules. Once congestion subsides, your data speeds will return to normal, subject to your Threshold.

4. Billing Cycle Reset

Your high-speed data Threshold resets at the start of each new billing cycle. Unused high-speed data does not carry over to the next billing cycle unless your plan explicitly states otherwise. Your billing cycle dates are shown in your online account and on your monthly statement.

You can monitor your current data usage at any time by:

  • Logging into your account at winmobile.us
  • Using the Win Mobile mobile app (available for iOS and Android)
  • Texting DATA to our support short code
  • Contacting Customer Care at support@winmobile.us

We will send automated notifications when you reach 80% and 100% of your high-speed data Threshold. You may manage notification preferences in your account settings.

5. Prohibited Uses

Regardless of your plan’s data Threshold, Win Mobile prohibits use of its network for activities that harm other customers or the integrity of our network. The following uses are not permitted under any plan:

  • Using your device as a router or hotspot to provide internet access to multiple devices or users in a commercial or enterprise setting, unless your plan specifically includes a hotspot or tethering allowance
  • Automated or machine-generated data traffic designed to avoid throttling measures
  • Running server software or services that generate continuous high-volume data traffic
  • Any unlawful activity, including distribution of illegal content or unauthorized access to computer systems
  • Any activity that intentionally degrades network performance for other customers

Violation of these prohibitions may result in suspension or termination of service in accordance with your Service Agreement.

6. Emergency Services and Safety

Data speed limitations under this Policy do not apply to calls or messages to 9-1-1 or other emergency services. Voice calls and SMS messages to emergency services remain fully functional regardless of your data usage status. Win Mobile complies fully with all FCC regulations regarding emergency communications.

7. Transparency and Open Internet Compliance

This Policy is published and maintained in accordance with FCC transparency requirements. Win Mobile does not block, throttle, or otherwise interfere with lawful internet traffic based on content, application, service, or source — except as described in this Policy for the legitimate network management purposes of maintaining service quality for all customers.

Win Mobile does not engage in paid prioritization. No content, application, or service provider pays Win Mobile to have its traffic treated preferentially over other lawful traffic.

If you believe we are not complying with our Open Internet obligations, you may file a complaint with the FCC at www.fcc.gov/consumers/guides/filing-informal-complaint.

8. Changes to This Policy

We may update this Policy from time to time to reflect changes in our network, our plans, or applicable law. When we make material changes, we will:

  • Post the updated Policy on our website at winmobile.us
  • Send notice via email or text message at least thirty (30) days before changes take effect where required by law or your Service Agreement
  • Update the Effective Date and Version information at the top of this document

Your continued use of WINMO services after the effective date of any changes constitutes your acceptance of the updated Policy. If you do not agree with the changes, you may cancel your service in accordance with the terms of your Service Agreement.
