Terms of Service

By purchasing, accessing, or using WINMO (a mobile service membership offered by Club Mobile LLC DBA Win Mobile), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not purchase or use the service.

1. Eligibility (18+ Only)

WINMO is intended strictly for individuals who are at least eighteen (18) years of age. By purchasing, you represent and warrant that you meet this requirement. Access by minors is strictly prohibited.

2. Nature of Service

WINMO is a mobile service membership that includes access to digital content as a member benefit.

Your purchase provides access to:

• Unlimited 5G mobile service on a nationwide network
• Hotspot and international roaming capabilities
• Digital content, commentary, analysis, and informational resources as determined by Win Mobile from time to time, included as a member benefit
• Member community access

Win Mobile does not provide financial advice, investment advice, gambling or betting services, wager placement services, or guaranteed outcomes of any kind. Any digital content included with your membership is provided for entertainment and informational purposes only.

3. Mobile Service Terms

WINMO provides eSIM-based mobile service built on a nationwide 5G network.

You acknowledge that:

• Mobile service is the primary product
• Service availability is subject to carrier limitations, device compatibility, network coverage, and geographic restrictions
• Data speeds may be reduced during periods of network congestion after 10GB of high-speed data
• Service quality, uptime, speed, and performance are not guaranteed
• You are responsible for ensuring your device is eSIM-compatible prior to purchase
• International roaming is available in select countries and is subject to applicable limitations

4. Digital Content (Included Member Benefit)

Digital content is included with your WINMO membership as a supplemental member benefit.

You acknowledge that:

• All digital content is for entertainment and informational purposes only
• Content is general in nature, opinion-based, and subject to change at any time without notice
• No content is guaranteed, predictive, or warrantied as accurate
• You will not rely on any content as a basis for financial, wagering, or any other decisions
• Any decisions you make in connection with content accessed through WINMO are made entirely at your own risk
• Win Mobile is not responsible for any outcomes, including gains or losses of any kind

5. No Guarantees / Results Disclaimer

Win Mobile makes no guarantees of any kind — express or implied — regarding outcomes, profitability, accuracy, or any specific result in connection with any digital content included with your membership. Any examples or references to past performance are not guarantees, are not typical, and are provided for illustrative purposes only. Past results do not predict future outcomes. No content provided through WINMO should be construed as a promise or representation of any specific result.

6. Billing, Final Sale & No Refunds

All purchases are final and non-refundable. By completing your purchase, you expressly agree that mobile service and any included digital content access are delivered immediately upon purchase, and that no refunds, credits, reversals, or chargebacks will be issued under any circumstances.

This policy applies regardless of dissatisfaction with service or content, perceived performance, failure to achieve any result, unused membership time, device incompatibility discovered after purchase, or failure to cancel prior to renewal. By completing your purchase, you waive any right to dispute charges based on performance, expectations, or any basis other than actual unauthorized fraud.

7. Subscription Terms

Subscriptions automatically renew on a recurring basis as disclosed at checkout. You are solely responsible for managing or canceling your subscription prior to renewal. Failure to cancel before a renewal date does not create eligibility for refunds or credits of any kind.

8. Cancellation Effects

If your WINMO membership is canceled, expires, or is terminated for any reason:

• Mobile service is discontinued at the end of the current billing period or immediately upon termination, whichever occurs first
• Access to all included digital content ends at the same time
• Your mobile line may transition to a standard paid plan through Club Mobile LLC if applicable
• No prorated refunds or credits will be issued under any circumstances

9. User Responsibility & Assumption of Risk

You are solely responsible for your actions, decisions, and compliance with all applicable federal, state, and local laws. Win Mobile does not monitor or control how members use or apply any information accessed through the membership. By purchasing and using WINMO, you expressly assume all risks associated with your use of the service and any digital content accessed through it.

10. Prohibited Use

You may not:

• Copy, reproduce, distribute, or resell any WINMO digital content
• Share access credentials or membership access with any third party
• Use WINMO for unlawful, misleading, or deceptive purposes
• Misrepresent Win Mobile or its services in any way
• Attempt to exploit, reverse engineer, or interfere with the platform or its infrastructure
• Use the mobile service for any prohibited or unlawful purpose under applicable telecommunications law

Violations may result in immediate termination without refund.

11. Release of Claims

To the fullest extent permitted by applicable law, you hereby release, discharge, and waive any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, and expenses of any kind — whether known or unknown, suspected or unsuspected — arising out of or in any way related to your use of WINMO, your mobile service, any digital content accessed through the membership, or any decisions made in connection with content accessed through the service.

This release extends to Club Mobile LLC DBA Win Mobile, its members, managers, officers, employees, agents, affiliates, successors, and assigns.

By purchasing, you acknowledge that you have read and understand this release and are voluntarily agreeing to its terms.

12. Hold Harmless Agreement

You agree to hold harmless Club Mobile LLC DBA Win Mobile, its members, managers, officers, employees, agents, affiliates, successors, and assigns from and against any and all claims, liabilities, losses, damages, judgments, costs, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of or access to WINMO mobile service; (b) your use of or access to any included digital content; (c) your violation of these Terms; (d) any decision made in connection with digital content accessed through the membership; or (e) any misuse of mobile service or digital content.

13. Indemnification

You agree to indemnify and defend Club Mobile LLC DBA Win Mobile and all affiliated parties against any third-party claims, damages, liabilities, or expenses arising from your use of the service, your violation of these Terms, or your misuse of any mobile service or digital content provided through the membership.

14. Limitation of Liability

To the maximum extent permitted by law, Win Mobile and Club Mobile LLC shall not be liable for any financial losses, indirect or consequential damages, lost profits, decisions made based on digital content, mobile service interruptions, network outages, coverage gaps, or any damages arising from your use or inability to use the service. If liability is found despite the foregoing, it shall be strictly limited to the amount paid for the current billing period only.

15. Termination Rights

Win Mobile reserves the right to suspend or terminate access at any time, without notice, for violations of these Terms, suspected abuse, nonpayment, or compliance reasons. Termination does not entitle you to any refund.

16. Modifications to Service or Terms

Win Mobile may modify the mobile service, included digital content, membership structure, pricing, or these Terms at any time without prior notice. Continued use of the service constitutes acceptance of any updates.

17. SMS and Text Message Marketing

By opting into WINMO’s SMS marketing program, you expressly consent to receive promotional messages, alerts, and marketing communications from Club Mobile LLC DBA Win Mobile. You confirm that you are the account holder or have the account holder’s permission to enroll.

• Standard message and data rates may apply
• Message frequency varies based on your interaction with the service
• To opt out, reply STOP to any marketing message. You may continue to receive non-promotional transactional messages related to your account
• Your mobile number will not be shared with third parties for marketing purposes without your explicit consent
• Win Mobile reserves the right to modify these SMS terms at any time; continued participation constitutes acceptance
